Credits

• Credits have no cash value and cannot be exchanged for cash
• Credits are non-refundable once used
• Unused credits may expire after 12 months of account inactivity

Payments

• All payments are processed securely through our third-party payment processors
• By making a payment, you represent that you are authorized to use the payment method
• We reserve the right to refuse or cancel any order at our discretion

Refunds

Refunds may be issued at our discretion for:

• Unused credits within 14 days of purchase
• Service disruptions or technical issues that prevent proper usage

5. Content and Intellectual Property

Your Content

By using our services, you retain ownership of any content you create or upload to our platform, subject to the licenses granted herein.

Generated Content

Subject to your compliance with these Terms and payment of applicable fees:

• You own the content generated by our AI services based on your inputs
• You may use generated content for personal or commercial purposes
• You may not claim ownership of our AI models or technology

Our Intellectual Property

Vacua Vita and its licensors own all intellectual property rights in our services, including but not limited to:

• Our platform, website, and applications
• Our AI models and algorithms
• Our logos, trademarks, and branding
• Our code, design, and user interface

You may not copy, modify, distribute, sell, or lease any part of our services or included software without our permission.

6. Prohibited Uses

You agree not to use our services to:

• Create, upload, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, or otherwise objectionable
• Create content that infringes upon or violates the intellectual property rights or other rights of any third party
• Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
• Engage in any activity that could disable, overburden, damage, or impair our services
• Attempt to gain unauthorized access to our systems or user accounts
• Use our services for any illegal or unauthorized purpose
• Generate deepfakes or other misleading content without proper disclosure
• Create content that depicts minors in inappropriate contexts
• Automate or script interactions with our services without our express permission

We reserve the right to moderate generated content and may refuse to process any request that violates these prohibited uses.

7. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

Upon termination:

• Your right to use our services will immediately cease
• Any unused credits may be forfeited
• We may delete your account data and generated content after a reasonable period

All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Disclaimers

Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

We do not guarantee that:

• Our services will always be available, uninterrupted, or error-free
• Generated content will meet your specific requirements or expectations
• Generated content will be completely unique or free from similarities to existing works
• Any errors or defects in our services will be corrected

You understand that AI-generated content may have limitations, and you are responsible for reviewing and assessing the suitability of any generated content for your intended purpose.

9. Limitation of Liability

To the maximum extent permitted by law, Vacua Vita and its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Any conduct or content of any third party on our services
• Any content obtained from our services
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability to you for all claims exceed the amount you have paid to us in the past twelve months.
